Disclaimers are not an afterthought. In today’s climate they must be top of mind for advertiser and agency professionals – not just their legal counsel.

The Competition Bureau’s recent enforcement actions regarding misleading advertising and the Supreme Court of Canada’s recent guidance on the 'general impression' test in its judgment against an advertiser of a contest promotion have made this patently clear. The Supreme Court Case also has implications for how advertisers define the average consumer – this will be a critical factor going forward.

Join ASC as Mr. Sibre shares his insights about what these recent legal developments mean for the appropriate use, content and placement of disclaimers in advertising, and how you can help ensure your advertising meets regulatory requirements.

Following Mr. Sibre’s presentation, Danielle Lefrançois, ASC’s Communications Manager (Quebec), will briefly discuss the Canadian Code of Advertising Standards requirements related to disclaimers and highlight several recent pertinent ASC Standards Council consumer complaint adjudications.

Hubert Sibre Hubert Sibre (Bar of 1993) is a partner in the Montreal office of Davis LLP and is a member of the firm's Business Solutions and Restructuring Group. His practice focuses primarily on commercial litigation, restructuring and insolvency. He has authored and co-authored several books and articles on restructuring, insolvency, credit, civil procedures and secured rights. In 2009, Mr. Sibre holds the prestigious designation as one of the Lexpert Rising Stars: Leading Lawyers Under 40. In 2010, he was listed by Lexpert as one of the very best in the “Canadian Litigator to Watch” list. Recently, Mr. Sibre successfully argued before the Supreme Court of Canada the first ever case relating to consumer law before this Court. The unanimous decision against “Time” is a landmark decision on many issues, including punitive damages in Quebec.
